These Terms of Service ("Terms") govern your use of ThisIsMN, the Minnesota business-directory service at thisis.mn and the ThisIsMN mobile application (together, the "Service"), operated by ThisIsMN ("we," "us," or "our") from Minnesota, United States. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

ThisIsMN is a directory of Minnesota businesses, events, and community information. Directory listings are compiled from public sources, from businesses themselves, and from community submissions. We work to keep information accurate, but we do not guarantee that any listing, hour, price, or event detail is current or correct. Confirm important details with the business before relying on them.
The businesses listed in the directory are independent. We are not a party to any transaction between you and a listed business, and we are not responsible for their goods, services, websites, or conduct.
You must provide accurate information when you create an account and keep your credentials secure. You are responsible for activity under your account. You must be at least 13 years old to create an account. We may suspend or terminate an account that violates these Terms or that we reasonably believe threatens the security or integrity of the Service.
The Service lets you submit content such as reviews, photos, event submissions, and business information ("Your Content"). You keep ownership of Your Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it for the purpose of operating, promoting, and improving the Service. This license ends for content you delete, except where the content has been shared with others who have not deleted it or where retention is required by law.
You are responsible for Your Content. You must have the rights to what you submit, and it must not be unlawful, deceptive, defamatory, or infringing.

We may moderate, remove, or decline to publish any content, and we may restrict accounts that violate these standards.
Business owners and authorized representatives may claim and manage a listing. By claiming a listing you represent that you are authorized to act for that business. We may verify claims, and we may remove or correct listing content that is inaccurate, deceptive, or violates these Terms. Claiming a listing does not transfer ownership of directory data to the claimant.
Some features are offered under paid plans. Prices and inclusions are shown at purchase. Payments are processed by our payment processors, and subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period. Unless required by law or stated otherwise at purchase, fees are non-refundable. We may change plan prices or features prospectively with reasonable notice.
The Service, including its software, design, and the compilation of the directory, is owned by ThisIsMN or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal and internal business purposes. You may not copy, modify, or create derivative works of the Service except as allowed by law.
If you believe content on the Service infringes your copyright, contact support@thisis.mn with the location of the content, a description of the work infringed, your contact information, and a statement of your good-faith belief. We will review and, where appropriate, remove infringing content.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that directory information is accurate or complete.
To the fullest extent permitted by law, ThisIsMN will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of one hundred US dollars ($100) or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You will indemnify and hold ThisIsMN harmless from claims arising out of Your Content, your use of the Service in violation of these Terms, or your violation of law or the rights of a third party.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including content licenses for retained content, disclaimers, limitations of liability, and indemnification) survive.
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Minnesota, and you consent to their jurisdiction. Nothing in this section limits rights you have under the consumer-protection laws of the place where you live.
We may update these Terms when the Service or legal requirements change. We will post the updated Terms with a new effective date and provide additional notice when the changes are material. Continued use of the Service after changes take effect constitutes acceptance.
